Mediation is on the rise and for good reason. Many couples logically see that getting attorneys involved in their Divorce can be a costly battle, both emotionally and financially. A court battle could easily reduce or eliminate the resources and assets acquired through the years of marriage. A better choice perhaps is mediation whereas both parties agree to work with a mediator and in turn agree to how their assets get divided on their own as opposed to a judge deciding this for them, although a judge still signs off in the end (rarely an issue). Arnold Schwarzenegger discovered a big error on his divorce documentation recently…..the paperwork denied his ex, Maria Shriver, of spousal support and denied paying for any of her legal fees, an error Arnold says (according to the New York Daily News) was made when he failed to read the paperwork thoroughly. As a result Arnold had to re-file the divorce paperwork. Apparently the mistake was made when his attorney checked the wrong boxes on the forms, something we see all the time!

Our service is a service that is used by a lot of people throughout Northern CA and sometimes I have to ask myself why more people don’t use a service like ours.  We had a client who came to us initially to discuss getting a Divorce in San Jose.  She had been married for about three years during which time her husband incurred a lot on her credit cards.  In the end the only thing she wanted was to be through with the marriage and if that meant letting him walk away from the debts he incurred, she was willing to do it.

Divorce can be a very emotional thing for most people but it can typically go much smoother if the parties agree on terms.  The first part of the agreement has to be agreeing to the divorce by both parties.  Believe it or not some spouses are not agreeable to the divorce even though eventually a judge is bound to grant the divorce after all is said and done, and the all part can be a lot.  None the less sometimes a spouse is unwilling to let go either emotionally and sometimes it is in spite.

We recently took a look at the rate of divorce in San Jose CA and the local Bay Area to see if perhaps living in a high tech area had any impact as to the divorce rate. The first thing we noticed was that most of the people working in the high tech field tended to get married later in life, which statistically means a lower divorce rate than had they married before they were 30 years old.

In the last year or so there has been a fair amount of media coverage on a practice that seemed worth exploring called “undivorcing”.  These are people that are divorced emotionally and physically, but not legally.  We don’t hear about this a lot because on the level of public information we cannot track the numbers associated with this trend like we can marriage certificates or divorce decrees, which are tracked by the census bureau.  Some of these people still live together but in separate bedrooms, sometimes because of the children, sometimes because of finances, but none the less they are “divorced” emotionally and physically, just not legally.
